Terms of Use

These terms govern the use of null418.com and of the services we provide electronically through it. They serve as the terms of service (regulamin) required by the Polish Act on Providing Services by Electronic Means.

2. What services the site offers

Through the site we provide the following electronic services free of charge:

• Browsing the content of the site, including the blog.
• Contact forms, to send us an enquiry.
• Null Brief newsletter, one email every two weeks for subscribers.
• Resource downloads (ebooks, guides and templates) in exchange for your email address.
• Call booking link, handled in an external scheduling tool.

The contract for each electronic service is concluded when you start using it (when you open the site, submit a form or confirm your subscription) and ends when you stop using it. You can unsubscribe from the newsletter at any time using the link in each email or by writing to us.

3. Technical requirements

You need a device with an internet connection, an up-to-date browser (Chrome, Firefox, Safari or Edge) with JavaScript enabled and, for the newsletter and resources, an active email address. Using the internet carries general risks, such as malware; we recommend keeping your device updated and protected.

4. Rules of use

When using the site, you agree not to:

• Send unlawful or offensive content, unsolicited advertising or third-party data without their permission.
• Attempt to gain unauthorised access to the site, the server or the database, or interfere with how they work.
• Introduce viruses or any harmful code.
• Extract content automatically or in bulk without our written permission.
• Impersonate another person or company.

We may block access or submissions from anyone who breaks these rules.

5. Informational content, prices and agency services

• The content of the site is informational. Articles, guides and resources explain general marketing approaches; they are not advice tailored to your company, nor legal, tax or financial advice.
• Published prices are indicative, exclude taxes and depend on your region. They do not constitute an offer within the meaning of the Polish Civil Code, but an invitation to negotiate (Kodeks cywilny art. 71).
• Our services are always contracted in writing. The scope, price, timelines, liability and data protection for each project are set by an accepted proposal or a signed contract, which prevails over anything stated on the site.
• We do not guarantee specific results. Marketing outcomes depend on factors we do not control, such as the market, the product, the budget or the work of the sales team.
• Our services are aimed at businesses and professionals, not consumers.

6. Case studies, figures, testimonials and trademarks

The case studies and figures we show describe the results of specific projects over a specific period and are not a promise that they will be repeated. Some relate to work that Alejandro Barreto, founder of Null Marketing, led as head of marketing within those companies, before founding the agency or as an external consultant. Where a curve is marked as illustrative, only the starting and ending values are real.

Testimonials are the genuine opinions of the people who sign them, taken from public recommendations or published with their permission. Company names and logos belong to their owners and are shown only to identify the work carried out, without implying endorsement or a current relationship. If you own a trademark and want us to remove it, write to us and we will do so.

7. Intellectual property

The texts, design, downloadable resources, graphics, logo and other content of the site belong to Null Marketing or its licensors and are protected by the Polish Copyright Act (ustawa o prawie autorskim i prawach pokrewnych) and EU law. You may view them and download the resources for your company's internal use. You may not resell them, publish them as your own or copy them substantially without our written permission. Quoting short excerpts with a link to the source is permitted.

8. Liability

We take care that the site works and that its content is accurate, but we do not guarantee that it will always be available or error-free, and we may change or withdraw it at any time. To the extent permitted by law, we are not liable for decisions you make based solely on the content of the site, for service interruptions or for the content of linked third-party sites.

Nothing above limits liability that the law does not allow to be limited, such as liability for wilful misconduct, or the rights the law grants to consumers or to sole traders who contract with consumer rights.

9. Complaints

If something on the site or in an electronic service does not work as it should, write to us at abarreto@null418.com stating your email address, what happened and when. We reply within 14 days.

10. Personal data

How we process your data is explained in the Privacy policy and the Cookie policy.

11. Governing law and changes

These terms are governed by Polish law. Disputes with businesses are submitted to the competent courts at the service provider's registered address; if you are a consumer, you keep the rights and jurisdiction granted to you by the law of your country of residence. We may update these terms for legal or technical reasons or because of changes to the services; the new version is published on this page with its date and applies from then on. If any clause proves invalid, the rest remains in force.
